Terms and Conditions for Home Esteem

1. Introduction

  • These Terms and Conditions ("Terms") govern the provision of feng shui services ("Services") by Home Esteem ("Provider") to you ("Client"). By booking and using our Services, you agree to be bound by these Terms.

2. Scope of Services

  • The Provider offers consultation services in feng shui, which include but are not limited to: spatial arrangement recommendations, energy flow analysis, and suggestions for enhancing harmony and balance in a given environment.

  • The consultations use the Form School and Intuitive feng shui, focusing on the Bagua map and environmental psychology.

  • The Provider offers Aging-in-Place consultation, based on National Association of Home Builders discipline, combined with feng shui principles.

  • The Provider will use the photographs provided by the client to assess the current layout, develop design concepts, and create visual proposals. The photos will also be used to coordinate with contractors and other team members involved in the project.

  • The Provider may use the photos of feng shui suggestions for its portfolio, webpages, or other media of marketing.

3. Booking and Payment

  • Booking: Services must be booked in advance, either through our website, via email, or by phone.

  • Payment: Payment is required at the time of signing the contract form otherwise agreed. We accept a check.

  • Cancellation and Refunds: Cancellations made [X] days before the scheduled service will receive a full refund. Cancellations made less than [X] days before the service will be subject to a [percentage or flat rate] cancellation fee.

4. Client Responsibilities

  • The Client agrees to provide accurate and complete information about the floorplan and property and any relevant circumstances affecting the service.

  • The Client is responsible for implementing the recommendations provided by the Provider. The Provider is not responsible for any outcomes resulting from the Client’s actions or lack of action.

5. Confidentiality

  • The Provider agrees to keep all information shared by the Client confidential, except where disclosure is required by law or where the information is already public.

6. Limitation of Liability

  • The Services provided are for informational purposes. The Provider makes no guarantees regarding the effectiveness of the Services. The Client acknowledges that feng shui is a subjective practice, and results may vary.

  • The Provider is not liable for any indirect, incidental, or consequential damages arising from the use of the Services.

  • Disclaimer: the provider does not take any legal responsibilities for accidents, injuries, illness, or other events including broken items that might occur during and after your home modifications. Suggestions by the provider are not intended as a substitute for medical, architectural, or financial professional advice.

7. Dispute Resolution

  • Any disputes arising from these Terms or the Services provided will be resolved through mediation. If mediation fails, the dispute will be subject to arbitration under the laws of Multnomah County.

8. Governing Law

  • These Terms are governed by and construed in accordance with the laws of Multnomah County.

9. Amendments

  • The Provider reserves the right to amend these Terms at any time. The Client will be notified of any significant changes.

10. Acceptance of Terms

  • By booking and using our Services, the Client acknowledges that they have read, understood, and agree to these Terms.
